1. Introduction
These Terms and Conditions (“Terms”) govern the provision of services by Lickrish Digital, Small Business Concierge Service and Small Business Kickstart (“we,” “our,” or “us”), to you, the client (“you” or “your”). By engaging our services, you agree to be bound by these Terms.
2. Services
We offer a range of services for small businesses, which may include but are not limited to:
- Small Business Kickstart program
- Small Business Concierge program
- Website build and design
- Website maintenance and updates
- Content creation (eBooks, blog posts, social media, etc.)
- Strategy coaching and consulting
- Email marketing setup and support
- Technical and administrative support
All services provided will be outlined in a written proposal emailed to you before work commences or at the time of joining a program.
3. Engagement and Payment
- Services are billed in advance, either as up-front yearly payment, monthly or quarterly subscription, or on an hourly/project basis as agreed.
- Invoices must be paid on receipt.
4. Cancellations and Refunds
By engaging our Small Business Kickstart Yearly Program you agree to a 12-month commitment and should you choose to exit the program early, no refunds will be given as the program has been competitively priced to provide a yearly support service at an affordable investment.
By engaging our Small Business Concierge Program or Yearly Maintenance Plan services, you agree to a 12-month commitment. You may choose to pay monthly, quarterly or annually. Regardless of the payment plan selected, this is a year-long agreement, and early cancellation does not waive your financial responsibility for the remainder of the 12-month term.
If you choose to cancel before the end of the 12-month period, a cancellation fee equivalent to the remaining balance of your agreed payment plan will apply. This ensures that we can continue to allocate the time, resources, and support necessary to maintain service quality for all clients.
By proceeding with your chosen payment option, you acknowledge and accept this commitment.
We reserve the right to terminate services at any time, with appropriate notice and a pro-rata refund if applicable.
5. Client Responsibilities
- You agree to provide timely and accurate information, materials, and access required to perform services.
- Delays caused by missing or incomplete information may impact delivery timeframes.
6. Confidentiality
- We agree to treat all business information provided by you as confidential and will not share it with third parties without your written consent.
- You agree not to share proprietary tools, templates, or strategies provided by us with others without permission.
7. Intellectual Property
- Unless otherwise stated, all original content created for you becomes your property upon full payment.
- We retain the right to showcase non-confidential work in our portfolio or promotional materials unless you request otherwise in writing.
8. Limitation of Liability
- We are not liable for any indirect, incidental, or consequential damages resulting from the use of our services.
- You agree to indemnify us against any claims arising from content or decisions made based on our recommendations or work.
9. Third-Party Services
- We may recommend or implement third-party tools or services (e.g., plugins, hosting, software). You are responsible for those accounts and fees.
- We are not responsible for the performance or changes to third-party services beyond our control.
- We may receive a small affiliate payment for some external services we may recommend. This by no means influences our recommendations to you and we will at all times recommend products we believe best suit your business, regardless of an affiliate payments that may or may not be made.
10. Changes to Terms
We reserve the right to update these Terms at any time. Continued use of our services after any changes constitutes your agreement to the new Terms.
11. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes shall be resolved in the jurisdiction of Cairns, Queensland, Australia.
